The Daily
• Negotiates and drafts videogame development agreements, publishing and distribution agreements, as well as more standard form contracts, such as master vendor agreements, services agreements and co-marketing agreements. Advises on all legal issues related to game development, production, distribution and marketing.
• Negotiates and drafts software license agreements, data hosting and ''SAAS'' agreements. Evaluates software licenses, including open source, and provides counsel to business and production teams on use restrictions. Coordinates content and data security review for vendors/service providers, as applicable.
• Negotiates and drafts various agreements (Licensed Publisher Agreements, Co-Marketing Agreements, etc.) with videogame hardware manufacturers. Advises operational groups (business development, marketing, sales and operations) across WBIE regarding terms.
• Negotiates and drafts inbound and outbound content licenses and provides legal advice and counsel to business development and production executives regarding license terms. Advises WBIE production and marketing teams regarding brand approvals and other license requirements.
• Provides counsel regarding marketing materials, online promotions, sponsorship, contest and sweepstakes. Understanding of advertising laws, as well as COPPA, FTC and DMCA compliance is desired.
• Gathers research from appropriate sources for talent rights and clearances, and drafts appropriate contracts to acquire rights or provide assistance to licensees or third parties, as appropriate, to acquire such rights. Rights research experience desired. Understanding of SAG, AFTRA, DGA and WGA guild requirements desired.
The Essentials
• Minimum 5-7 years experience handling transactional work (traditional entertainment, interactive entertainment and/or other digital media) is preferred.
• J.D. degree from an accredited law school required.
• Admission to California Bar required and membership must be in good standing .
• Must have excellent negotiating and drafting skills and must be detail oriented.
• Knowledge of interactive entertainment and digital media preferred.
• Working knowledge of domestic and international data protection and privacy regulations preferred.
• Experience handling rights research.
• Knowledge of marketing and advertising laws.
• Working knowledge of union and guild issues helpful.
• Should possess strong PC Skills, including proficiency with MS Outlook, Word and Excel.
• Must have excellent interpersonal & communication skills.
• Must be a team player and willing to pitch in whenever needed.
• Must have the ability to work in a fast-pace environment and to prioritize work to meet specific deadlines.
• Must be self-motivated & results oriented.
